I often hear potential clients say, “Why would I fight my ticket(s) when I am guilty of the charge?
Did you know that traffic violations do not state how many demerits will be applied to your drivers license if you simply plead guilty? In Alberta class 5 drivers are given 15 demerit points before they are suspended. Graduated Drivers receive 8. Along with suspensions, traffic convictions on your driver’s abstract can have a massive impact on your insurance premiums.
What happens to the demerit points on your abstract if you have already served your suspension?
Many people believe that they will get “all” of their demerits back after serving a suspension. This is a MYTH.
A class 5 driver will start at 7 demerits while a GDL driver will start at 4 demerits.
How long do demerits stay on my abstract if I simply plead guilty and pay the ticket?
It takes two years from the conviction date for the demerits to be removed from your drivers abstract. That is a potential two-year increase in Insurance premiums. The conviction will remain on your abstract.
Is it the charge one is convicted of that is important or the demerits that are associated with the charge?
Both are equally as important. It is best to have the ticket amended to a lesser charge than to be found guilty of the original charge. The amended charge will have less demerit points (or zero) and will reflect better on your abstract. This in turn will alleviate the strain on your abstract and your insurance premiums.
